I'll go out on a limb and say that many of the bugs and problems to do with Linux legacy hardware compatibility stem from kernel development. The driver and module architecture of Linux changes from time to time IIRC. Somewhat disturbing, but I'm sure it'll turn out okay.

A driver handles the abstraction of hardware to a software construct. Operating systems handle allocation and management of other more abstract constructs (such as files, sockets, and processes), rather than JUST hardware access, as drivers do. Does this answer your question?

I like GNOME most of the time, but Linus is right that sometimes it assumes you don't know anything. I mostly like it because it's aesthetically pleasing and does everything I want it to. Another downside is the amount of RAM it uses, but that's a gripe for another day.
